RULES AND REGULATIONS

1. Booth Size: Exhibitors may utilize only the space assigned to it by MalicJewels. Exhibitor may not modify or alter the size of the booth provided by MalicJewels. No on-site increases or stretching or extension into aisles, walkways, adjoining booths or spaces will be permitted.

2. Set-up and Move-out: Exhibitor may only set-up or break-down its booth for move-out at the times set by MalicJewels for each show. Set up hours will typically be Thursday from 3:00 p.m. – 8:00 p.m. and on Friday from 8:00 a.m. – 12:00 p.m. All set up must be completed at least 30 minutes prior to show opening. Move-out hours are Sunday from 5:00 p.m. – 8:00 p.m.

3. Show Hours: Show hours may vary. Typically, show hours are Friday from 12:00 p.m. – 6:00 p.m., Saturday from 10:00 a.m. to 6:00 p.m. and Sunday from 11:00 a.m. to 5:00 p.m. The terms “show opening” or “opening of show” when used herein mean 30 minutes prior to the first day of a show.

4. Sign-In/Registration: Each Exhibitor shall sign in with MalicJewels prior to setting up. At sign in, each Exhibitor will receive a permanent security badge with a photo ID, booth number and location and any additional rules and regulations pertaining to the specific show. Exhibitor and its representatives must wear the security badge at all times while inside the show hall. This is done strictly for the security of the show and the benefit of the Exhibitors.

5. Signage and Displays: MalicJewels will provide Exhibitor with one location/company name sign. The sign will be available to Exhibitor prior to set-up and will be returned to MalicJewels upon move-out. Exhibitor is responsible for providing their own unique company signage/banner, which must comply with the following requirements:

a. All signs must be of fire retardant material.
b. All signs must be no larger than 10’ Wide x 4’ Tall.
c. Signs may only be attached to the back of the Exhibitor's booth or their own displays.
d. Signs may not be attached with tape or adhesive to poles or other equipment provided by or rented to Exhibitor by MalicJewels.
e. Signs must be professionally produced and cannot be handwritten or crudely produced.
f. No signs or displays greater than 5 feet may be placed on the front and/or sides of the booth, with the exception of poles used for lighting only.
g. Displays, racks or pegboards up to 8 feet in height may only be placed on the back wall of a booth so long as they do not interfere with the adjoining booth and may only extend 2 feet from the back wall of the booth.

6. Electricity: MalicJewels will provide electricity to each booth. Electrical outlets for power consumption provided are 120 volts, 60 cycles, single phase and alternating current. MalicJewels will provide wattage to each booth based on size. Additional wattage up to a total of 3000 watts per booth may be available for purchase from MalicJewels. Any Exhibitor requiring additional wattage for their display must place an order for additional electricity at least 30 days prior to show opening. Exhibitor is solely responsible for display lighting, extension cords and power strips. All lighting or equipment utilized by Exhibitor must be code compliant and meet all local restrictions/requirements. All extension cords must be 3-wire grounded cords. No halogen bulbs, handmade lights or piggybacking will be permitted.

7. Tables, Poles and draping: MalicJewels will provide each Exhibitor with tables, poles, chairs and draping as set forth on its Standard Booth Layouts. Exhibitor may not utilize tape or adhesive on MalicJewels provided equipment. Exhibitors are expressly prohibited from attaching metal racks or other items to the MalicJewels provided poles. Exhibitor is responsible for the care and maintenance of those items during the time of the show and will be held responsible by MalicJewels for any and all damage caused by Exhibitor to the MalicJewels provided equipment. Exhibitor may request that it utilize its own display equipment rather than that provided by or available for rent by MalicJewels. Exhibitor must obtain permission from MalicJewels at least 30 days prior to the opening of the show for use of such items. MalicJewels has absolute discretion regarding whether to accept or reject Exhibitor’s substitute display.

8. Use of Space: Exhibitor may use the booth space solely for sale and display of gems, minerals, jewelry, precious stones and metals, beads, findings and other items directly associated with gems and jewelry. Items of an offensive or lascivious nature will not be permitted. MalicJewels has sole discretion to determine whether or not an Exhibitor’s display complies with this provision. Exhibitor must maintain its display in a neat and orderly manner throughout the show and may not set up their display in such a way to interfere with the display of an adjoining booth or Exhibitor. Exhibitor may not in its display create noise, sounds or odors that project beyond the booth space or which interfere with the show or other Exhibitors. No cooking is permitted and no pets, other than service animals, are permitted in the show. Displays, racks or pegboards up to 8 feet in height may only be placed on the back wall of a booth so long as they do not interfere with the adjoining booth and may only extend 2 feet from the back wall of the booth.

9. Dismantling Other Booths: Exhibitors may not, under any circumstances, remove equipment from other booths, whether said booth has been occupied or not. Exhibitors violating this regulation will be subject to a fine.

10. Trash and Cleanliness: Exhibitor is responsible for maintaining the cleanliness of their booth at all times throughout set-up, the show and move-out. MalicJewels will provide trash bags at the beginning of each show for Exhibitors to place their daily waste in. Exhibitors shall place the sealed trash bags in the aisles at the close of business each day and they will be picked up. Exhibitors leaving debris, waste, food, etc. in their booths at the close of a show will be charged a clean up fee of $100 per show.

11. Conduct: Exhibitor shall conduct itself in a professional and courteous manner at all times. Violation of this rule, and any other rule established by MalicJewels relation to the conduct of its shows may result in the immediate expulsion of Exhibitor from a show and termination of its participation in any future shows.

12. Compliance with Laws: Exhibitor assumes all responsibility for compliance with all local, municipal, state and federal ordinances, regulations, laws, policies and codes of whatever sort or nature including those relating to fire, safety, health, taxation, workers compensation and licensing.

13. Liability: Exhibitor will be responsible for all injury or damage to the event hall, event hall fixtures, furniture and equipment and MalicJewels provided equipment directly or indirectly caused by them or their employees, agents or representatives.

14. Limitation of Liability: In no event shall MalicJewels’ officers, members, employees, agents or managers be personally liable for actual, consequential or incidental damages to an Exhibitor for any loss, theft, damage or destruction to its goods, business or display materials or for any injury to his/her person or that of their representatives, agents or employees. In no event shall MalicJewels be responsible for any claim of lost business or profits or any speculative damages.

15. Repairs, Goldsmiths: Any Exhibitor who provides repair and/or alteration services, including without limitation, Goldsmiths, accepts complete responsibility for any damage, loss or injury as a result of its activities. Anyone providing such services must have a fully charged and certified fire extinguisher ready for emergency use in their booth at all times. All repairs and alterations must be completed the same day.

16. Disputes: During the run of the show MalicJewels will have the authority to resolve any and all disputes between an Exhibitor and a customer regarding returns, exchanges, damaged goods and/or refunds. Exhibitors hereby grant MalicJewels the authority to render a final and binding decision regarding any disputes that arise between Exhibitors during the show and which are presented to MalicJewels during the run of the show in which the dispute arose.

17. Sales Receipts: Exhibitors are required to provide sales receipts for all items sold or services preformed.

18. Notices: All notices required by these rules or the application/agreement must be submitted in writing to MalicJewels at 3822 W. White Canyon Canyon, Queen Creek, AZ 85242 and sent either via overnight mail, personal delivery, fax, or via email with acknowledgment receipt. Notices to Exhibitor will be sent to the contact information provided on the application. It is Exhibitor's responsibility to provide updated contact information.
